1.1 You will be able to access most areas in www.sugarhillbrighton.com without registering your details with us. Certain areas of this website are only open to you if you register.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check this website from time to time to review the then current terms and conditions because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.
2. Ordering from Sugarhill Brighton
2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process, you will be given the opportunity to check your order and to correct any errors. You agree to provide current, complete and accurate information for all purchases made on our website. Sugarhill Brighton cannot be held responsible for incorrect information being entered at the checkout. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we despatch the order. We will send you a despatch confirmation by email. When we despatch the order the purchase contract will be made even if your payment has been processed immediately unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order: (a) where goods are not available; (b) where we are unable to obtain authorization for your payment; (c) if there has been a pricing or product description error; or (d) if you do not meet any eligibility criteria set out in our terms and conditions.
2.4 In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.
2.5 We are unable to change the item ordered or delivery address once an order has been placed. Please note that any changes you make to your account after placing an order will not take effect immediately and won't apply to orders already placed.
2.6 We do not offer exchanges or gift exchanges. If you have ordered something as a gift and the recipient wants to exchange it, you will need to return the item back to us using our returns portal and place a new order. If you have been gifted something from our website and would like to exchange it, the person who placed the order will need to return the item back to us using our returns portal and place a new order.
3.1 VAT will be charged, where appropriate. We reserve the right to change the VAT rate as required by law. For orders placed within the EU, all prices shown on sugarhillbrighton.com include the applicable VAT rate. If your order is being delivered outside of the EU, VAT will not be charged however the selling price will remain the same.
3.2 Where we charge separately for packing, postage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.
3.3 Our prices are reviewed periodically. Any prices shown on the website are current for the product at that time.
3.4 Prices for our products may change from time to time, but changes will not affect any order you have already placed. Once you have completed your order, you agree to the price paid for each item. If the items you have ordered drop in price after you have received them, we cannot refund the difference in price.
4. Cancellation and Returns Policy
4.1 If you wish to cancel your order, you can do so by returning goods to us in accordance with clause 4.2 below.
4.2 You can return goods you have ordered from us for any reason at any time within 28 days of receipt for a full refund. You can do this via our free UK returns portal, international returns portal or at your own cost.
4.3 Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required.
4.4 The rights to return the goods to us as referred to in clause 4.3 will not apply in the following circumstances: - in the event that the product has been used or damaged by you in any way, or if the Sugarhill Brighton sale tag has been removed. Full details of these rules of return can be found on our Delivery and Returns Page. The provisions of this clause 4.4 do not affect your statutory rights.
4.5 Sugarhill Brighton is not responsible for any customer errors in relation to the preparation of returns, in particular, any items that do not belong to Sugarhill Brighton and subsequently returned to us by mistake. Our warehouse team will always try to identify and locate items sent in error, but we cannot guarantee this will always be possible. If we are able to identify the items returned in error, and you would like us to return them to you, the associated delivery cost will need to be paid for by you.
4.6 Purchases made with a Gift Card and returned to us, will be refunded back to the original Gift Card only. Purchases made with a bank/credit card and returned to us, will be refunded back to the original bank/credit card only. Refunds made to a bank/credit card cannot exceed the original payment amount.
5.1 Although we use all reasonable means to ensure that your order is delivered within a specified time frame, we cannot accept responsibility for late deliveries due to circumstances outside of our control. During sales or busy periods standard delivery may take an additional 3-5 working days.
5.2 Sugarhill Brighton do not accept liability for any delivery instructions issued to the delivery company by the customer. If you leave instructions requesting a parcel to be left in a different location you deem as a “safe place” such as in the shed, garage or with a neighbour, we cannot accept responsibility if the goods are damaged or you fail to receive your parcel.
5.3 In keeping with our sustainable fabrics, our orders ship in plastic-free packaging made of paper from sustainable sources. Sugarhill Brighton cannot be held responsible for damage caused to the packaging during delivery/transit. We highly recommend receiving your order in person, to avoid any damage that could occur from the parcel being left outside.
5.4 If items are undeliverable to you by the courier/postal services these orders will be held for a defined period of time (varies per company) for you to collect. If uncollected items exceed this limit, they will be returned to us as the sender. All items will be automatically refunded and returned to stock. You will be notified via email of the refund once processed.
5.5 Please allow the full *estimated delivery timeframe for your order to arrive. If you believe the order has been lost/delivered in error, we ask you check all possible safe places/near by neighbours before contacting us. If you wish to raise a delivery investigation please email email@example.com and provide your order number/tracking number/full delivery address. We have a limited timeframe to investigate once the goods have been marked as delivered, we ask you contact us as soon as possible so we can assist you further. Please note that we are unable to open a missing parcel investigation until 10 working days after the estimated delivery date. We cannot offer any refund/replacement until the investigation is resolved by the courier/postal service.

We take great care to represent accurately the colours used in our collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Equally, images shot in daylight may show a different shade of the colour than those shot in a studio. Every reasonable care has been taken to ensure that the descriptions are accurate however specifications may change. From time to time Sugarhill Brighton collections may contain items created using various techniques such as hand dye and hand beading. Colour, design and embroidery variations are inherent in the handmade process. Any irregularities add to the creative uniqueness of this garment. Wear with pride, your piece is unique!
DISCOUNT CODES & PROMOTIONS
We reserve the right to withdraw any promotional discounts and to refund any orders that involve the use of invalid or incorrect voucher/discount codes. Promotional free goods are subject to stock limitations. Should the item advertised be unavailable we will endeavour to provide a similar item - stock willing. This does not affect your statutory rights as a consumer.
Unless otherwise expressly stated in the terms and conditions for a particular promotional code, these cannot be combined and cannot be used in conjunction with any other offer/discount. If you have more than one promotional code and the codes cannot be combined, it is up to you to use the promotional code that has the biggest benefit to you.
If you forget to apply a discount to your order, we may be able to refund the discount amount back to the original method of payment, but only 28 days after the date of purchase.
Sugarhill Star status is decided by an analysis of spending and returns habits. Please note that your status may change, without notice, due to these factors and these perks will be deactivated. To receive the free delivery reward, the correct discount code must be entered at the checkout along with the correct registered email address. This code is non-transferrable. It can only be used with your email address. This discount code can be used with one additional promo code per order.
